Terms of Service for Briefly

1. Acceptance of Terms

By downloading, installing, or using Briefly ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

Briefly is a mobile application that allows users to:

• Create and manage career journal entries
• Track professional accomplishments and growth
• Generate AI-powered career summaries
• Sync data across devices
• Access premium features through subscription

3. Account Registration

3.1 Account Creation

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account
• You must be at least 13 years of age to use this App

3.2 Account Security

• Notify us immediately of any unauthorized use of your account
• We are not liable for any loss or damage arising from unauthorized account access
• You may not share your account with others

4. Subscription Terms

4.1 Free Trial

• New users receive a 30-day free trial OR 10 AI-generated summaries, whichever comes first
• After the trial period, a paid subscription is required to continue using premium features
• You will be notified before your trial ends

4.2 Paid Subscriptions

• Monthly Subscription: $1.99 per month, auto-renews monthly

4.3 Payment and Billing

• Subscriptions are processed through Apple's App Store
• Payment will be charged to your Apple ID account at confirmation of purchase
• Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage your subscription and turn off auto-renewal in your Apple ID Account Settings

4.4 Cancellation and Refunds

• You may cancel your subscription at any time through your Apple ID Account Settings
• Cancellation takes effect at the end of the current billing period
• No refunds are provided for partial subscription periods
• Refund requests are handled by Apple according to their policies

4.5 Changes to Pricing

• We reserve the right to change subscription prices
• Price changes will not affect current subscribers until their next renewal period
• You will be notified of price changes in advance

5. User Content

5.1 Your Responsibility

• You are solely responsible for all content you create, upload, or store in the App
• You must not include sensitive, confidential, proprietary, or classified information
• You are responsible for complying with any NDAs or confidentiality agreements
• Use aliases or generic terms for sensitive information

5.2 Content Ownership

• You retain all ownership rights to your journal entries and content
• By using the App, you grant us a limited license to store and process your content to provide the service
• We do not claim ownership of your content

5.3 Prohibited Content

You may not use the App to create, upload, or store content that:

• Violates any law or regulation
• Infringes on intellectual property rights
• Contains malware or harmful code
• Harasses, threatens, or harms others
• Contains false or misleading information
• Violates these Terms

6. AI-Generated Content

6.1 AI Summaries

• AI-generated summaries are created using OpenAI's GPT models
• Summaries are based on your journal entries and are for informational purposes only
• AI-generated content may contain errors or inaccuracies
• You should review and verify all AI-generated content before using it

6.2 No Professional Advice

• AI-generated summaries do not constitute professional career advice
• We are not responsible for decisions made based on AI-generated content
• Consult qualified professionals for career guidance

7. Data and Privacy

7.1 Privacy Policy

• Our Privacy Policy explains how we collect, use, and protect your data
• By using the App, you agree to our Privacy Policy
• The Privacy Policy is incorporated into these Terms by reference

7.2 Data Security

• We implement reasonable security measures to protect your data
• However, no method of transmission or storage is 100% secure
• You use the App at your own risk

7.3 Data Export and Deletion

• You may request to export your data at any time
• You may request deletion of your account and data at any time
• Upon deletion, your data will be permanently removed within 30 days

8. Acceptable Use

You agree NOT to:

• Use the App for any illegal purpose
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the App's operation
• Reverse engineer, decompile, or disassemble the App
• Use the App to spam, phish, or distribute malware
• Violate any applicable laws or regulations
• Impersonate others or misrepresent your affiliation
• Collect or harvest user data without permission

9. Intellectual Property

9.1 App Ownership

• The App, including its design, code, features, and trademarks, is owned by Briefly
• These Terms do not grant you any ownership rights to the App

9.2 License to Use

• We grant you a limited, non-exclusive, non-transferable license to use the App
• This license is for personal, non-commercial use only
• The license terminates if you violate these Terms

10. Disclaimers and Limitations of Liability

10.1 "As-Is" Basis

• THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND
• WE DO NOT GUARANTEE THE APP WILL BE ERROR-FREE OR UNINTERRUPTED
• WE DO NOT WARRANT THE ACCURACY OR RELIABILITY OF AI-GENERATED CONTENT

10.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

• ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES
• LOSS OF DATA, PROFITS, OR BUSINESS OPPORTUNITIES
• DAMAGES RESULTING FROM USE OR INABILITY TO USE THE APP

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE PAST 12 MONTHS

11. Indemnification

You agree to indemnify and hold harmless Briefly, its affiliates, and their respective officers, directors, and employees from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of third parties
• Your content or data

12. Termination

12.1 Termination by You

• You may terminate your account at any time through the App settings
• Termination does not entitle you to a refund for unused subscription time

12.2 Termination by Us

We may suspend or terminate your account if:

• You violate these Terms
• You engage in fraudulent or illegal activity
• Your account has been inactive for an extended period
• Required by law

12.3 Effect of Termination

• Upon termination, your right to use the App immediately ceases
• Your data will be deleted within 30 days
• Provisions that should survive termination (payment obligations, disclaimers, etc.) will remain in effect

13. Changes to Terms

• We may modify these Terms at any time
• We will notify you of material changes via the App or email
• Continued use of the App after changes constitutes acceptance
• If you do not agree to changes, you must stop using the App and cancel your subscription

14. Third-Party Services

The App integrates with third-party services:

• Supabase: Database and authentication
• OpenAI: AI-powered summaries
• Apple App Store: Payment processing

Your use of these services is subject to their respective terms and policies. We are not responsible for third-party services.

15. Governing Law and Dispute Resolution

15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict of law principles.

15.2 Dispute Resolution

• Any disputes shall first be attempted to be resolved through good-faith negotiation
• If negotiation fails, disputes may be resolved through binding arbitration or small claims court

16. Miscellaneous

16.1 Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Briefly.

16.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in effect.

16.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

16.4 Assignment

You may not assign or transfer these Terms without our written consent. We may assign these Terms without restriction.

16.5 No Agency

These Terms do not create any agency, partnership, or joint venture relationship.
